Rent reduction: For noise, mildew and more

Unfortunately, it is not possible to say in general terms which deficiency reduces the rent by how many percent. Although there are guidelines for, for example, noise protection, heating the apartment or nuisance from cigarette smoke, in the end the individual circumstances of each case are decisive for the exact amount of the rent reduction. However, the rent reduction always refers to the gross rent, i.e. including all additional costs.

Important: In order to avoid the risk of termination, for example, if it turns out that the rent reduction was too high or unjustified, you should pay the full rent subject to recovery. To be on the safe side, have your case checked legally.

As a tenant, you have the right in the event of a rental deficiency to have the landlord remedy the deficiency immediately and at his own expense. In addition, you may be entitled to a rent reduction for the period during which the defect existed.

Important: As a tenant, you have the obligation to notify the landlord of the defect. The notification of defects should always be made in writing. You should describe the defect very precisely or, if necessary, have it verified by an expert so that the landlord can rectify the defect. The legislator prescribes that a correct notice of defect to the landlord must be made "immediately". If the submission is delayed, you as a tenant may be deprived of the right to a rent reduction. A rent reduction is therefore not possible retroactively. Whoever continues to pay the rent in full without reservation despite the defects cannot claim anything back later. To prevent this, you should inform your landlord as soon as possible after the occurrence of defects.

A lump sum of ten euros is charged in advance for processing a case, which is deducted from the success fee in the event of successful rectification of defects or rent reduction. The following is an overview of the contingency fees:
Removal of defects

• Mildew: 199 Euro

• Other defects: 49 Euro

If you have remedied the defect yourself and CONNY has successfully claimed compensation, CONNY ⅓ will charge the negotiated compensation as a success fee.

Reduction of the rent
In the case of a successful reduction of the rent by CONNY, the fee per month ⅓ of the rent reduction is If the deficiency has been remedied and you pay the full rent again, simply send us a proof (e.g. a bank statement showing that you again pay 100% of the rent).

Example calculation
Case: Heating failure
warm rent: 800 Euro
Rent reduction negotiated by CONNY: 50 percent
Duration of the rent reduction: one month

CONNY negotiates a 50 percent rent reduction and persuades the landlord to repair the heating system. The repair takes one month. In this case, your monthly saving is 400 Euros. CONNY calculates ⅓ the savings as a success fee - that is 133 Euro. Since CONNY also arranged the removal of the defect, another 99 Euros are charged - a total of 232 Euros. When the order is received, you have already paid a processing fee of ten euros. This will be deducted from the sum of 232 Euros. Thus, the success fee in this example calculation is 222 Euro. You have saved 178 Euro and did not have to do anything else than to order CONNY.
